Terms and Conditions of Sale
ARTICLE 1 - PRICE
The prices of our products are indicated in euros, all taxes included (VAT and other applicable taxes on the day of the order), unless otherwise stated and excluding processing and shipping costs. In the case of an order to a country other than mainland France, you are considered the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and amounts do not fall under the responsibility of L'Esprit Gothique. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros. L'Esprit Gothique reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation and subject to availability. The products remain the property of L'Esprit Gothique until full payment of the price. Note: As soon as you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.
ARTICLE 2 - ORDERS
You can place an order on our website: https://esprit-gothique.fr/. The contractual information is presented in French and will be confirmed at the latest at the time of your order validation. L'Esprit Gothique reserves the right not to record a payment, and not to confirm an order for any reason, particularly in the event of a supply problem, or in the event of difficulty concerning the received order.
ARTICLE 3 - VALIDATION OF YOUR ORDER
Any order placed on the website https://esprit-gothique.fr/ implies acceptance of these General Conditions. Any order confirmation entails your full and complete acceptance of these general terms of sale, without exception or reservation. All the data provided and the recorded confirmation constitute proof of the transaction. You declare that you have perfect knowledge of it.
ARTICLE 4 - PAYMENT
Validating your order implies the obligation to pay the indicated price. Payment for your purchases is made by credit card through the secure system.
ARTICLE 5 - WITHDRAWAL
In accordance with the provisions of Article L.221-18 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty. Returns must be made in their original and complete condition (packaging, accessories, instructions...). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. Return costs are at your expense. In the event of exercising the right of withdrawal, L'Esprit Gothique will refund the amounts paid, within 14 days following the notification of your request and via the same payment method used when ordering.
ARTICLE 6 - DELIVERY
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page. In case of a shipping delay, please send us an email, we will find a solution together. In accordance with legal provisions, in case of a delivery delay, you have the possibility to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. In case of deliveries by a carrier, L'Esprit Gothique cannot be held responsible for a delivery delay due exclusively to the unavailability of the customer after several appointment proposals.
ARTICLE 7 - WARRANTY
All our products benefit from the legal warranty of conformity and the warranty against hidden defects, provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned, exchanged, or refunded (under certain conditions). All claims, exchange, or refund requests must be made by mail or email to the following address (within 30 days after delivery): contact@espritgothique.com
The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions...). However, the shipping costs will be at your expense. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 5.
ARTICLE 8 - LIABILITY
The products offered comply with the French legislation in force. L'Esprit Gothique cannot be held liable in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order. Furthermore, L'Esprit Gothique cannot be held responsible for damages resulting from improper use of the purchased product.
ARTICLE 9 - APPLICABLE LAW IN CASE OF DISPUTES
The language of this contract is French. These terms of sale are subject to European law.
ARTICLE 10 - INTELLECTUAL PROPERTY
The brand name and brand image (including design) of L'Esprit Gothique, available on the site https://esprit-gothique.fr/, are the exclusive intellectual property of L'Esprit Gothique. No authorization is given for the reproduction, exploitation, redistribution, or use, even partial, of these intellectual property elements, whether for commercial or non-commercial purposes.

L'Esprit Gothique reserves the right to collect personal information and personal data concerning you.
